We invite you to access and use our online services (the \u201cServices\u201d), which are made available to you through our website located at&nbsp;<a href=\"https:\/\/www.njrise.org\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.njrise.org\/<\/a>&nbsp;(the \u201cWebsite\u201d)<\/p>\n\n\n\n<p>We provide our Website and Services to you subject to the following Terms of Use, which may be updated by us from time to time without notice to you. By visiting the Website and\/or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by the terms and conditions of these Terms of Use and the terms and conditions of our Privacy Policy, which are hereby incorporated by reference (collectively, this \u201cAgreement\u201d). If you do not agree to any of these terms, then please do not access or use the Website and the Services.<\/p>\n\n\n\n<p>Capitalized terms not defined in these Terms of Use shall have the meaning set forth in our Privacy Policy.<\/p>\n\n\n\n<ol><li><strong><u>DESCRIPTION AND USE OF THE SERVICES<\/u><\/strong><\/li><\/ol>\n\n\n\n<p>Rise is an independent not-for-profit community services agency that helps individuals and families in need in New Jersey. Rise partners with other community services and agencies to offer wraparound services, and also offers its own direct services to the community including but not limited to, food pantry and emergency shelter (each, a \u201cRise Program\u201d). You may also volunteer with Rise for one or more volunteer opportunities available in Rise Programs (each a \u201cVolunteer\u201d). You may also make donations to support our Rise Programs and Services (each, a \u201cDonation\u201d).<\/p>\n\n\n\n<p>When you make a Donation, you acknowledge and agree that the Website will link to a third-party payment vendor of ours who will process your payment (\u201cThird-Party Payment Vendor\u201d), and that any information that you submit in connection with such Donation will be submitted to such Third-Party Payment Vendor and will be subject to the privacy policy and terms of use of such Third-Party Payment Vendor.<\/p>\n\n\n\n<p>Rise is under no obligation to accept any individual as a Volunteer, donor or a participant in our Rise Program and may accept or reject any registration in its sole and complete discretion.<\/p>\n\n\n\n<ol start=\"2\"><li><strong><u>RESTRICTIONS<\/u><\/strong><\/li><\/ol>\n\n\n\n<p>The Services are available for individuals aged 13 years or older. If you are 13 or older, but under the age of majority in your jurisdiction, you should review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand it.<\/p>\n\n\n\n<ol start=\"3\"><li><strong><u>USE OF YOUR PERSONAL INFORMATION<\/u><\/strong><\/li><\/ol>\n\n\n\n<p>Your use of the Website and\/or the Services may involve the transmission to us of certain Personal Information. If this Agreement is terminated in accordance with the Termination provision above, such termination shall not affect the validity of the following provisions of this Agreement, which shall remain in full force and effect: \u201cIntellectual Property,\u201d \u201cNo Warranties\/Limitation of Liability,\u201d \u201cIndemnification,\u201d \u201cTermination of the Agreement,\u201d and \u201cMiscellaneous.\u201d You may not assign this Agreement. Our failure to act on or enforce any provision of the Agreement shall not be construed as a waiver of that provision or any other provision in this Agreement. No waiver shall be effective against us unless made in writing, and no such waiver shall be construed as a waiver in any other or subsequent instance. Except as expressly agreed by us and you in writing, this Agreement constitutes the entire Agreement between you and us with respect to the subject matter, and supersedes all previous or contemporaneous agreements, whether written or oral, between the parties with respect to the subject matter. The section headings are provided merely for convenience and shall not be given any legal import. You cannot opt out of receiving transactional e-mails related to your account. We will use commercially reasonable efforts to process such requests in a timely manner.
